काठमाडौं । सरकारले शिक्षा नियमावली (दशौँ संशोधन) मार्फत सामुदायिक विद्यालयका स्थायी शिक्षकहरूको सरुवा व्यवस्थामा व्यापक परिवर्तन गरेको छ। नयाँ व्यवस्थाअनुसार एउटै विद्यालयमा तीन वर्ष सेवा पूरा गरेका स्थायी शिक्षकलाई आवश्यकताअनुसार अर्को विद्यालयमा सरुवा गर्न सकिने व्यवस्था गरिएको छ।
सरकारको यो व्यवस्थाले वर्षौँसम्म एउटै विद्यालयमा कार्यरत शिक्षकलाई आवश्यकता अनुसार अन्य विद्यालयमा परिचालन गर्ने उद्देश्य राखेको छ। शिक्षा क्षेत्रको गुणस्तर सुधार, शिक्षक व्यवस्थापनलाई प्रभावकारी बनाउने तथा दुर्गम क्षेत्रमा पनि अनुभवी शिक्षकको पहुँच सुनिश्चित गर्ने लक्ष्य नियमावलीले लिएको छ।
यी अवस्थामा अनिवार्य सरुवा लागू नहुने
नियमावलीले केही विशेष अवस्थाका शिक्षकलाई भने अनिवार्य सरुवाबाट छुट दिएको छ। अपाङ्गता भएका शिक्षक, अरूको सहारामा मात्र हिँडडुल गर्न सक्ने गम्भीर अशक्त, गर्भवती शिक्षिका तथा दुई वर्षभन्दा कम उमेरका बालबालिकाका आमालाई यो व्यवस्था अनिवार्य रूपमा लागू नहुने उल्लेख गरिएको छ।
रिक्त पद भए ७ दिनभित्र जानकारी दिनुपर्ने
शिक्षक सरुवा, अवकाश, मृत्यु, बर्खास्ती वा नयाँ दरबन्दी सिर्जना भएमा पद रिक्त भएको मानिनेछ। यस्तो अवस्थामा विद्यालयले सात दिनभित्र एकीकृत शैक्षिक व्यवस्थापन सूचना प्रणाली (IEMS) मा विवरण अद्यावधिक गरी सम्बन्धित स्थानीय तहलाई जानकारी गराउनुपर्नेछ।
स्थानीय तहले पनि जानकारी प्राप्त भएको सात दिनभित्र शिक्षक सेवा आयोगमार्फत पदपूर्ति गर्ने वा सरुवाबाट व्यवस्थापन गर्ने निर्णय गर्नुपर्ने व्यवस्था गरिएको छ।
१५ दिन सार्वजनिक सूचना अनिवार्य
सरुवा प्रक्रिया पारदर्शी बनाउन विद्यालयले कम्तीमा १५ दिनको सार्वजनिक सूचना प्रकाशित गर्नुपर्नेछ। सूचना विद्यालय, स्थानीय तह तथा जिल्ला शिक्षा समन्वय इकाइको वेबसाइटमा समेत राख्नुपर्ने व्यवस्था गरिएको छ। सार्वजनिक सूचना बिना गरिएको सरुवा बदर हुन सक्ने नियमावलीमा उल्लेख छ।
प्राथमिकता निर्धारणका आधार
यदि एउटै पदका लागि धेरै शिक्षकले आवेदन दिएमा प्राथमिकता निश्चित मापदण्डका आधारमा निर्धारण गरिनेछ। अपाङ्गता भएका, गम्भीर अशक्त, गर्भवती तथा साना बालबालिकाका आमालाई पहिलो प्राथमिकता दिइनेछ।
त्यसपछि शिक्षकको ज्येष्ठता, शैक्षिक योग्यता र तालिमको आधारमा कुल ६५ अंकको मूल्याङ्कन गरिनेछ। अंक बराबर भएमा सेवा अवधि, उच्च शैक्षिक योग्यता, पारिवारिक अवस्था तथा अन्तिम विकल्पका रूपमा गोलाप्रथाबाट छनोट गरिने व्यवस्था गरिएको छ।
यी अवस्थामा सरुवा नहुने
नियमावलीले केही अवस्थामा सरुवा गर्न नपाइने स्पष्ट व्यवस्था पनि गरेको छ। तीन वर्ष सेवा पूरा नभएका शिक्षक, एक वर्षभित्र अनिवार्य अवकाशमा जाने शिक्षक, शिक्षक सेवा आयोगमा विज्ञापन पठाइसकिएको पद, विषय वा तह नमिल्ने अवस्था तथा महिला शिक्षकको कोटामा असर पर्ने अवस्थामा सरुवा गर्न नपाइने उल्लेख गरिएको छ।
त्यस्तै, पारस्परिक सरुवा भएको पाँच वर्ष नपुगी पुनः सरुवाको आवेदन दिन पनि पाइने छैन।
सरुवा स्वीकृत भएर पनि नगए दुई वर्ष प्रतिबन्ध
सरुवा स्वीकृत भएपछि शिक्षकले अन्तिम समयमा सरुवा अस्वीकार गरे वा निवेदन फिर्ता लिएमा त्यस्ता शिक्षकले दुई वर्षसम्म पुनः सरुवाका लागि आवेदन दिन नपाउने व्यवस्था गरिएको छ।
सरुवा गर्ने अधिकार कसलाई?
एउटै स्थानीय तहभित्रको सरुवा सम्बन्धित स्थानीय तहले गर्नेछ। फरक स्थानीय तह वा जिल्लाबीचको सरुवा भने सम्बन्धित स्थानीय तहहरूको सहमतिमा शिक्षा विकास तथा समन्वय इकाइले गर्ने व्यवस्था छ। प्रधानाध्यापकको सरुवा पनि सम्बन्धित निकायहरूको सहमतिमा हुनेछ।
नयाँ नियमावली लागू भएसँगै शिक्षक सरुवा प्रणाली थप व्यवस्थित, पारदर्शी र मापदण्डमा आधारित हुने अपेक्षा गरिएको छ। यद्यपि यसको कार्यान्वयन प्रभावकारी हुने वा राजनीतिक प्रभाव बढ्ने भन्ने विषयमा शिक्षा क्षेत्रमै बहस सुरु भएको छ।
Major Reform in Government School Teacher Transfers: Mandatory Transfer After Three Years of Service
Education Regulations (10th Amendment) introduce sweeping changes to the transfer system, with new provisions on priority, exemptions, and transparency.
Kathmandu — The Government of Nepal has introduced major changes to the transfer system for permanent teachers in community (government) schools through the 10th Amendment to the Education Regulations. Under the new provision, permanent teachers who have completed three years of service at the same school may now be transferred to another school based on administrative requirements. The new policy aims to improve teacher management, enhance the quality of education, and ensure a more balanced distribution of experienced teachers across community schools, including those in remote areas. Teachers Exempt from Mandatory Transfer The mandatory three-year transfer rule will not apply to certain categories of teachers. These include teachers with disabilities, severely physically challenged teachers who require assistance to move, pregnant teachers, and mothers with children below two years of age. Vacant Positions Must Be Reported Within Seven Days A teaching position will be considered vacant if a teacher is transferred, retires, dies, is dismissed, or if a new teaching post is created. Schools must update the vacancy in the Integrated Education Management Information System (IEMS) and notify the concerned local government within seven days. The local government must then decide within seven days whether to fill the position through the Teacher Service Commission or by transfer. Public Notice Mandatory Before Transfer To ensure transparency, schools must publish a public notice for at least 15 days before initiating a teacher transfer. The notice must also be published on the websites of the school, local government, and District Education Coordination Unit. Transfers made without following this process may be cancelled. Priority Criteria for Transfer If multiple teachers apply for the same position, priority will be given first to eligible teachers with disabilities, severely disabled teachers, pregnant teachers, and mothers with children under two years of age. Other applicants will be evaluated on a 65-point system based on seniority (35 points), academic qualifications (20 points), and professional training (10 points). Additional criteria include years of service, higher academic qualifications, family reunification, and finally a lottery if all other factors are equal. Cases Where Transfer Is Not Allowed The regulations prohibit transfers for teachers who have not completed three years of service, those with one year or less remaining before mandatory retirement, positions already sent for recruitment through the Teacher Service Commission, mismatched subject or level requirements, situations affecting female teacher quotas, and teachers seeking another transfer within five years of a mutual transfer. Refusing an Approved Transfer Teachers who withdraw or refuse an approved transfer after being selected will be barred from applying for another transfer for two years. Authorities Responsible for Transfers Transfers within the same local government will be handled by the respective local authority. Transfers between different local governments or districts will require the consent of both local governments and will be managed by the Education Development and Coordination Unit. Transfers of headteachers will also follow this process. The government believes the revised transfer system will make teacher management more transparent, systematic, and efficient. However, the new policy has already sparked debate, with some expecting improvements in educational quality while others fear increased political influence in teacher transfers.
